Modificación de la Base Imponible: El Concurso de Acreedores y el IVA
Concurso de Acreedores, Recuperación Impagados Añadir Comentario
Las facturas pendientes de pago durante una situación concursal dan lugar a que el acreedor repercute los IVAs no cobrados y el deudor se los deduce, no habiéndolo pagado. Hace ya meses tratamos el asunto en este post.
Conviene retomarlo después de leer el blog de Antonio Esteban donde explica cómo abordar el problema de forma clara. Aunque la Agencia Tributaria no lo pone especialmente fácil.
En resumen, existen dos opciones de tratamiento del IVA repercutido a una empresa concursada:
- Deducir de la base imponible el IVA facturado antes de la declaración de concurso del acredor y dentro del plazo de un mes desde la declaración del mismo.
- Deducir la base imponible el IVA de facturas consideradas incobrables, considerando facturas incobrables las que lleven más de un año sin haberse pagado y que el acreedor haya instado su cobro mediante reclamación judicial.
La primera opción tiene poco margen temporal (sólo un mes) y la segunda opción es raramente admitida por la Agencia Tributaria.
Los aspectos operativos de su aplicación no son sencillos. Os recimiendo que leáis este post para mayor detalle. La ley tributaria española no facilita la modificación de las bases imponibles, los tiempos para llevarlo a cabo son muy justos y el requerimiento de información excesivo.
